Terms of Service

These Terms govern your access to and use of Comeback (the "Service"), operated by Dagga Inc. ("we", "us"). By creating an account or installing Comeback on your store, you agree to these Terms.
1. The Service
Comeback gives merchants a wallet-based loyalty program: Apple and Google Wallet passes, customer messaging, and reactivation tools. We provide the software; you remain responsible for your customer relationships, the offers you send, and your compliance with local marketing law.
2. Your account
- You must be 18+ and authorized to sign up on behalf of your business.
- You're responsible for keeping your dashboard password secure.
- One subscription covers one store; multi-store plans are available on Pro and Enterprise.
3. Billing
Plans renew monthly (or annually if chosen) at the price displayed on the pricing page. You can cancel at any time from your billing settings; you keep access through the end of the period you've already paid for.
4. Acceptable use
You agree not to:
- Use the Service to send unsolicited bulk messages or spam.
- Send content that's misleading, deceptive, or violates a third party's rights.
- Attempt to reverse-engineer, resell, or sublicense the Service.
- Interfere with the integrity of the Service or its underlying infrastructure.
5. Your data & customers
Customer data you collect through Comeback remains yours. We process it on your behalf as outlined in our Privacy Policy and DPA. You're responsible for obtaining the consents your local law requires from your customers before sending them messages.
6. Intellectual property
The Comeback software, design, and brand are ours. You receive a non-exclusive, non-transferable license to use the Service while your subscription is active. Your brand assets remain yours; you grant us a limited license to display them inside the Service (e.g. on wallet passes, in the dashboard).
7. Termination
You can cancel any time. We may suspend or terminate accounts that violate these Terms, abuse the Service, or fail to pay. On termination, you can export your customer data for 30 days; after that, we delete it from production systems.
8. Disclaimers & limitation of liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, our total liability to you in any 12-month period is limited to the amount you paid us in that period. We are not liable for indirect, incidental, or consequential damages, lost profits, or lost data beyond what local law mandates.
9. Governing law
These Terms are governed by the laws of the Province of Quebec, Canada, without regard to its conflict of laws principles. Any dispute will be resolved in the courts of Montréal, Quebec.
10. Changes
We may update these Terms. If we make material changes, we'll notify you by email or in the dashboard before they take effect. Continued use after the effective date means you accept the updated Terms.
